Edward Fisher, 89, was seriously injured when he was struck by a car driven by Ruth M. Tickle, then 84, which mounted the sidewalk after hitting another car, court papers said.
Fisher, whose leg was badly broken, recently settled his lawsuit against Ms. Tickle for $425,000, said his lawyer, Rodney Stilwell.
"Even though his hip injury healed fairly well, he lost the ability to do many of the things he enjoyed to do before the accident," said Stilwell, a partner in the Castleton Corners firm of Tracy & Stilwell.
The attorney said his client, who had been very active and helped out at his son-in-law's chemical-supply business, can no longer drive, walk distances or negotiate stairs.
"No moss grew under this man's shoes" before the incident, said Stilwell, who called the settlement "substantial, yet fair and reasonable."
According to Stilwell and court papers, Fisher had parked his car in the Citibank lot on Victory Boulevard near Gansevoort Boulevard and was walking to the front door. The retired machinist lives in the neighborhood,
Ms. Tickle simultaneously drove out of the CVS parking lot across the street, tried to make a left turn and hit a Sunnyside-bound car on Victory, said the police accident report.
The Sunnyside resident lost control of her 2009 Honda, smacked a sign post and rode along the sidewalk before striking Fisher, the police said. The Honda came to rest after hitting another pole.
Fisher's right hip was fractured, requiring surgery and rehabilitation, court papers said.
Ms. Tickle's lawyer could not immediately be reached for comment.
