Sentences handed in district court

A Brenham man put on probation for a fatal car accident in 2006 has been sentenced to two years in a state jail for violating the terms of that probation.

Jonathan Jacob Rios, 24, was ordered to jail in district court action here Thursday, Judge Terry Flenniken presiding.

Rios was the driver of a vehicle that went around a curve at a high rate of speed on FM 50 on Jan. 14, 2006. The vehicle went off the road, struck a tree and was sliced in half. A passenger in the vehicle was thrown out by the impact.

Rios pleaded guilty to criminally negligent homicide, and was sentenced to two years in state prison, but that was probated for five years.

Among the stipulations of his probation was that Rios pay $10,000 into a trust fund for the victim’s child.

District Attorney William Parham said Rios violated his probation by being convicted of evading arrest in June 2010, driving while intoxicated in May 2010 and failure to identify a fugitive from justice last April in Brazos County.

Prosecutors also said Rios admitted to drinking alcoholic beverages, didn’t report to his probation officer, was delinquent on court-ordered payments and community service, and driving while his license was suspended.

In addition to two years in a state jail, Rios was also ordered to pay $181,075 in restitution, court costs and his court-appointed attorney’s fees.
