At the conclusion of their investigation, the Houston wrongful death attorneys at Grossman Law Offices filed suit against the establishment, alleging their vicarious involvement in the fatal wreck. Filed in the 129th Judicial Court of Harris County, Texas, the suit (Cause No. 2011-40078) states on or about the evening of December 31, 2010, Mr. Renaud was purportedly "sold, served and/or provided alcoholic beverages... even though it was apparent to the Defendant that (he) was obviously intoxicated."

In this condition, the decedent "presented a clear danger to himself and to others." On his way home from "Defendant's premises", in an "obvious intoxicated state," Renaud "lost control of his vehicle and crashed," sustaining "life-threatening injuries that resulted in his death." An autopsy later revealed the decedent's blood alcohol level "exceeded two times the legal limit."

Houston dram shop attorney Keith Purdue comments, "We believe this to be a classic dram shop cause of action, for which we are known to aggressively pursue. The suit alleges the victim was not only served 'after he reached the point of intoxication,' but that he was served 'after he was obviously intoxicated.'"

Attorney Purdue continues, "To be legally licensed to serve alcoholic beverages, bartenders and servers are trained by the Texas Alcoholic Beverage Commission to spot an 'obviously intoxicated' patron and stop service. When they fail to do so, either by making a planned business decision or simply shear negligence, there should be some accountability. This accountability is precisely what our lawsuits seeks."
